DESCRIPTION:

Tech Environmental provided technical input towards a settlement agreement that resolved a landfill odor lawsuit. The landfill is operated by Waste Management in southern Florida. The landfill is located in an industrial area, and has an industrial neighbor directly abutting the landfill to the east. Tech Environmental provided an odor assessment of the landfill, an odor assessment of the surrounding industrial area, technical interpretations of the applicable odor regulations, and addressed the potential concerns with odor settlement language proposed by the abutter's attorney.

The neighbor had complained of odor in the past and had reservations about future landfill cells that would be physically closer to their common industrial property line. The neighbor proposed an odor nuisance determination procedure in a draft settlement agreement. Tech assisted the landfill and its legal team with the practical odor measurement equipment limitations and the potential impact of the proposed program. Tech made recommendations to better define the odor monitoring program and help the facility understand its odor potential.
