DESCRIPTION:

Residents of a resort building in Hyannis, Massachusetts were bothered by noise from a restaurant located 100 feet from their property.  The residents complained that the noise of voices, dishes, and music was disrupting the quiet enjoyment of their property both inside as well as at outdoor decks and common areas.  They contacted Tech to determine if the source of noise was in compliance with State and local noise bylaws.

Tech concluded that the restaurant had not been designed to adequately shield adjacent residential areas from excessive noise pollution.  The analysis established that the restaurant was creating a noise nuisance condition for the residents and was violating both the Massachusetts DEP Noise Policy and the Town of Hyannis Noise Bylaw.  Violations were found to stem from both outdoor dining activity and from rooftop HVAC equipment at the restaurant.
